1. Acceptance of Terms

By accessing and using the Service provided by Terrasakti ("Company", "we", "us", or "our"), you ("User", "Customer") agree to accept and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not access or use the Service.

These Terms constitute a legally binding agreement between you and Terrasakti regarding your use of our mining operations management software-as-a-service platform.

2. Services Description

Terrasakti provides a cloud-based platform for mining fleet management, manpower tracking, timesheet processing, and operational analytics ("Service"). We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service irrespective of your subscription plan, strictly in accordance with these Terms.

3. User Accounts and Security

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or otherwise suspect any security breaches related to the Service.

4. Intellectual Property Rights

The Service, including all proprietary content, information, software, graphics, text, images, and trademarks ("Intellectual Property"), is the exclusive property of Terrasakti and its licensors.

Customer Data: You retain all rights and ownership of your data entering the system ("Customer Data"). You grant us a worldwide, royalty-free license to access, use, process, copy, distribute, perform, export, and display Customer Data only as reasonably necessary (a) to provide, maintain, and improve the Service; (b) to prevent or address service, security, support, or technical issues; or (c) as required by law.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Terrasakti be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall preferably be resolved by amicable negotiation. If no settlement is reached within thirty (30) days, the dispute shall be referred to and finally resolved by arbitration in Indonesia in accordance with the determination of BANI (Badan Arbitrase Nasional Indonesia).
